"Cooking Tour of Tuscany" Sweepstakes

1. Entry period:
The Carando "Cooking Tour of Tuscany" Sweepstakes ("Sweepstakes") begins on September 1, 2008 at 12:01 a.m. Central Time ("CT") and ends on October 3, 2008 at 11:59 p.m. CT ("Entry Period"). Sponsor's computer is the official time keeping device for the Sweepstakes.
2. Eligibility:
The Sweepstakes is open to legal residents of the 48 contiguous United States and the District of Columbia who are 18 years of age and older. Employees, officers, directors, agents, successors, and assignees of Carando Foods ("Sponsor"), its parents, subsidiaries, affiliates, advertising and promotion agencies, Promotion Mechanics Inc. ("Administrator"), or other parties involved in any aspect with the creation, production, operation, execution and fulfillment of the Sweepstakes (collectively, "Sponsor and its Agents") and members of the immediate families (spouses and parents, children and siblings and their spouses) and persons living in the same household (whether related or not) of such individuals are not eligible. Void in AK, HI, PR, and where prohibited.
3. To enter: There are two ways to enter:
Online: Visit www.carando.com, (the "Website"), complete the online entry form and submit your entry so that it is received by Sponsor's server no later than 11:59 p.m. CT on October 3, 2008.
By Mail: Complete an official entry form available in participating stores, or hand print your name, complete address, phone number, age, and email address (optional) on a 3" x 5" piece of paper. Mail your entry to be postmarked by October 3, 2008 and received by October 10, 2008 to: Carando "Cooking Tour of Tuscany" Sweepstakes Entry, PO Box 491, Springfield, MA 01102-0491. No mechanical reproductions permitted.
Limit one entry per person/email address per day, regardless of method of entry.
4. Winner selection / notification / odds of winning:
On or about October 17, 2008, Sponsor will select the potential winner in a random drawing from among all eligible entries received. Potential winner will be notified by mail, overnight courier, email and/or phone at the postal address/email address/phone number provided with entry. Actual means of notification will be determined by Sponsor at its sole discretion. No responsibility is assumed by Sponsor for any incorrect postal address, email address or phone number associated with an entry, or any change of address, email or phone number of entrant after entry submission. Potential Grand Prize winner will be required to complete a notarized affidavit of eligibility, a liability release and (where legal) a publicity release, which must be returned within the time period specified in potential winner's notification letter. Any failure to timely return required documents, noncompliance with the terms of these rules or the return of any prize or prize notification as undeliverable will cause prize to be forfeited in its entirety, and an alternate potential winner to be selected. Odds of winning a prize depend on number of eligible entries.
5. Grand Prize:
One (1) Grand Prize: a 7 day/6 night cooking-themed trip for winner and one (1) guest to the Tuscany region of Italy, approximate retail value $7,500. The Grand Prize consists of round trip economy air travel for Grand Prize Winner and one (1) guest to Italy from the major commercial airport nearest to Grand Prize Winner's residence (as determined by Sponsor); double occupancy hotel accommodations (one room) for 6 nights; cooking activities for winner and guest as exclusively determined by Sponsor; and ground transportation to/from hotel and activities. Expenses not specified herein are the responsibility of the Grand Prize Winner and his/her guest. Actual value will be determined by Grand Prize Winner's residence and fare fluctuations. Air carriers, hotels and other transportation will be selected exclusively by Sponsor. Travel and accommodations are subject to availability and certain restrictions, blackout dates may apply. Travel must be booked at least 45 days in advance of departure date, and travel dates are subject to Sponsor's approval. Sponsor reserves the right to change travel dates as necessary. Travel must be completed by October 31, 2009 or prize will be forfeited in its entirety. All taxes (including without limitation Federal, state and local taxes) in connection with the Grand Prize, and the reporting consequence thereof, are the sole responsibility of the Grand Prize Winner. Grand Prize Winner's guest must be 18 years of age or older and will be required to complete, sign and return a notarized Liability Release (and where lawful, a Publicity Release) prior to issuance of travel documents. Grand Prize Winner and guest must travel on the same itinerary and will be responsible for all necessary travel authorizations, passports, and for any travel insurance. No prize transfer. No prize substitution except by Sponsor due to unavailability, in which case a prize of comparable or greater value will be awarded.
6. Conditions of Participation:
You are not a winner until your entry has been verified, and you have fully complied with these Official Rules. If any potential winner or guest is 18 or older, as is required for participation, but not of the age of majority in state of residence (a "Minor"), prize will either be awarded in the name of parent or legal guardian ("Parent"), or Parent must ratify and sign any and all documents required of potential winner/participant, at Sponsor's sole discretion. By participating, participants (or Parent, if entrant is a Minor) agree [a] to be bound by these Official Rules and decisions of Sponsor which shall be final and binding in all matters; [b] to release Sponsor and its Agents from any and all injuries, liability, losses and damages of any kind (including any travel or travel activity related thereto), including, without limitation, personal injury and/or death or property damage, sustained in connection with his/her participation in the Sweepstakes, from his/her receipt, possession, acceptance and/or use or misuse of any prize, or for any error in the announcement of any prize; [c] that the Sweepstakes is governed by laws of the United States and all entrants hereby submit to the jurisdiction and venue of the federal, state and local courts located in Kansas City, MO for resolution of all claims and disputes, and [d] by accepting a prize, to the announcement/use of his/her name, voice, image, and/or likeness for trade, advertising, publicity, broadcast and promotional purposes without compensation (unless prohibited by law) by Sponsor and those acting pursuant to Sponsor's direction, in each case in any and all media now known or hereafter discovered, worldwide, in perpetuity, including but not limited to the World Wide Web, without notice, review, or approval, and agree to execute specific consent to such use if asked to do so.
7. General:
Sponsor and its Agents are not responsible for and shall not be liable for: [a] electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or for any human, typographical, printing or other error relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in the administration of the Sweepstakes, processing of entries; the announcement of the prize or in any Sweepstakes–related materials, [b] failed, incomplete, garbled, or delayed computer transmissions; [c] late, lost, garbled, misdirected, incomplete, stolen, delayed, misdirected or postage-due entries or mail; [d] inaccessibility of the Website in whole or in part for any reason; [e] damage to entrants' or any person's computer or other equipment or the contents thereof; or [f] any condition caused by events that may cause the Sweepstakes to be disrupted or corrupted. Sponsor reserves the right in its sole discretion to cancel, terminate, modify, or suspend the Sweepstakes if fraud, technical failures or any other factor beyond Sponsor's reasonable control (including without limitation, hurricane, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, war, terrorist threat or activity or insurrection) impairs the integrity of the Sweepstakes (or portion thereof), as determined by Sponsor in its sole discretion, and limit entries to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion. In the event the Sweepstakes is cancelled, Sponsor reserves the right, at its discretion, to award the prize from among all eligible non-suspect entries received up to time of such action. Entry information and any other materials submitted become the property of Sponsor and none will be returned. In no event will Sponsor be obligated to award more prizes than the number of prizes stated in these Official Rules. In the event of any conflict with any Sweepstakes details contained in these Official Rules and Sweepstakes details contained in point of sale, radio and print advertising, promotional packaging or any other Sweepstakes materials, the details of the Sweepstakes set forth in these Official Rules shall prevail. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. In case of any dispute regarding identity of person submitting an electronic entry, the entry will be deemed submitted by the natural person who is the authorized account holder of the email address stated at the time of entry. Although Sponsor attempts to ensure the integrity of the Sweepstakes, Sponsor and its Agents are not responsible for the actions of entrants or other individuals in connection with the Sweepstakes, including entrants' or other individuals' attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity, or proper conduct of the Sweepstakes. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or Web site; to be acting in violation of the Official Rules; to be acting in violation of the terms of the Web site, or to be acting in a non-sportsmanlike, inappropriate or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to obtain more entries than the maximum number permitted, using multiple/different identities or any other methods including entry automation, macros, or scripts will void all of that person's entries. 8. Use of Entrant Information:
Information submitted in connection with the Sweepstakes will be treated in accordance with these Official Rules and Sponsor's Privacy Policy (as may be amended from time to time), currently located at http://www.carando.com/privacy.asp; provided, that in the event of any conflict between these Official Rules and such Privacy Policy, the terms and conditions of these Official Rules shall prevail.
